This FIOR LLC Privacy Policy (the "policy") describes the specific policies and procedures we use to collect, utilize, disclose, share and protect your Personal Information. We refer to FIOR LLC as "FIOR", "Prosperly""we" or "us".

Remember that your use of FIOR's Services and platforms is at all times subject to our Terms of Use Agreement which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use Agreement. Together with Terms of Use Agreement, this Privacy Policy governs your use of our platform and services.

FIOR is committed to the protection of our visitors, users and clients (also referred to as "you" or "your") privacy. We understand that keeping your information secure and confidential is critical to earning and keeping your trust. Let us be clear - we do not rent, sell or trade your Personal Information.

How to Use this Privacy Policy

This policy describes if and how your Personal Information is shared and/or disclosed, how we collect and use other information and how we address other privacy matters -- such as deletion of your Personal Information upon request and opting-out of marketing communications. Lastly, we describe methods for contacting FIOR if you have privacy questions, comments or feedback.

"Personal Information" means your personally-identifiable information such as your name, email or mailing address, phone number, account credentials (user id and passwords), social security number, government ID numbers and other information that can be used to identify you personally.

We also collect and use other information that we obtain from your activities using our services. This includes information that you do not explicitly provide to us but which may be implicitly provided to us as part of such activities. The following describes in further detail the information we collect at various stages of our relationship with you.

When you visit any of our websites or download our apps, we consider you a Visitor. This section describes our privacy practices related to this use case.

When you register, create a User Account on our platforms and begin using our services, we consider you a User. Behavioral Remarketing

FIOR LLC uses remarketing services to advertise on third party websites to you after you visited our Service. We and our third-party vendors use cookies to inform, optimize and serve ads based on your past visits to our Service.

Our Use of Google Analytics and google AdWords

Google AdWords and Google Analytics remarketing service is provided by Google Inc. We use Google Analytics to help us understand how you interact with our website and mobile app, and to improve the user experience. To do this, we share a unique identifier with Google. For information on how Google Analytics collects and processes data, as well as how you can control information sent to Google, see "How Google uses data when you use our partners' sites or apps" linked here.

You can opt-out of Google Analytics for Display Advertising and customize the Google Display Network ads by visiting the Google Ads Settings page: http://www.google.com/settings/ads. You can learn about Google Analytics' currently available opt-outs, including the Google Analytics Browser Ad-On, here. Google Analytics Opt-out Browser Add-on provides visitors with the ability to prevent their data from being collected and used by Google Analytics.

Facebook (Visitor Action Pixels)

We use the “visitor action pixels” from Facebook Inc (1 Hacker Way, Menlo Park, CA 94025, USA, or, if you are based in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”)) on our website. This allows user behavior to be tracked after they have been redirected to the provider’s website by clicking on a Facebook ad. This enables us to measure the effectiveness of Facebook ads for statistical and market research purposes. The data collected in this way is anonymous to us, i.e. we do not see the personal data of individual users. However, this data is stored and processed by Facebook, which is why we are informing you, based on our knowledge of the situation. Facebook may link this information to your Facebook account and also use it for its own promotional purposes, in accordance with Facebook’s Data Usage Policy. You can allow Facebook and its partners to place ads on and off Facebook. A cookie may also be stored on your computer for these purposes. The legal basis for the use of this service is Art. 6 paragraph 1 sentence 1 letter f GDPR. Facebook adheres to the Self-Regulatory Principles for Online Behavioral Advertising established by the Digital Advertising Alliance. You can also opt-out from Facebook and other participating companies through the Digital Advertising Alliance in the USA, the Digital Advertising Alliance of Canada in Canada or the European Interactive Digital Advertising Alliance in Europe, or opt-out using your mobile device settings.

Social Media Features

Our Web site and some surveys may include Social Media Features. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features are hosted by a third party. Your interactions with these Features are governed by the privacy policy of the company providing it.

Mixpanel

We may use the Mixpanel, Inc. ("Mixpanel") technology to perform statistical evaluations. This enables us to optimize product features, measure user behaviours and better understand how users interact with the product. Usage information and Personal Data is stored by Mixpanel and is subject to their privacy policy. As with site links and social media plugins, FIOR LLC has no control over how Mixpanel may use the collected or stored information and is therefore not responsible for their privacy practices. Calendly

We may use the calendly.com ("Calendly") technology to allow website visitors to book meetings with us. Usage information and Personal Data may be stored by Calendly and is subject to their privacy policy. As with site links and social media plugins, FIOR LLC has no control over how Calendly may use the collected or stored information and is therefore not responsible for their privacy practices. Google reCAPTCHA

We may use https://www.google.com/recaptcha (“reCAPTCHA”) technology to detect abusive traffic on out website and to protect the website from spam. Usage information and Personal Data may be stored by reCAPTCHA and is subject to their privacy policy. FIOR LLC has no control over how reCAPTCHA may use the collected or stored information and is therefore not responsible for their privacy practices. Sentry

We may use Functional Software, Inc. ("Sentry") technology to provide real-time error tracking for our web apps, mobile apps and games, which gives developers the insight needed to reproduce and fix crashes. Usage information and Personal Data may be stored by Sentry and is subject to their privacy policy. FIOR LLC has no control over how Sentry may use the collected or stored information and is therefore not responsible for their privacy practices. Split.io

We may use https://www.split.io/ (Split.io) technology to implement feature flags in our overall software development lifecycle. Usage information and Personal Data may be stored by Split.io and is subject to their privacy policy. Prismic

We may use Prismic ("Prismic") technology as content management system that houses all of our articles, images, and other content. We may use Render ("Render") technology as a hosting solution for our websites and technology applications. Usage information and Personal Data may be stored by Render and is subject to their privacy policy. Automate.io

We may use Automate.io ("Automate IO") technology as an application integration platform that connects our business processes. Usage information and Personal Data may be stored by Automate IO and is subject to their privacy policy. Activecampaign

We may use https://www.activecampaign.com/ ("ActiveCampaign") technology as an email service provider for our web forms, newsletters, and email marketing. To do this, ActiveCampaign tracks user data such as first name, last name, email, and phone number. ActiveCampaign also tracks user activity, such as but not limited to email opens, email clicks, and website interactions. Usage information and Personal Data may be stored by ActiveCampaign and is subject to their privacy policy. FIOR LLC has no control over how ActiveCampaign may use the collected or stored information and is therefore not responsible for their privacy practices. Rebrandly

We may use https://www.rebrandly.com/ ("Rebrandly") technology as a link tracking solution for our websites, services, and email marketing. How to Request Deletion of the Personal Information We Collect

FIOR allows you to delete your account. Please email legal@prosperly.app to request that your account is deleted.

We will retain information on deleted accounts as required for legal and security purposes.

Opt-out Information

Like many companies online, we use services provided by Google, Facebook and others companies that use tracking technology. These services rely on tracking technologies – such as cookies and web beacons – to collect directly from your device information about your browsing activities, your interactions with websites, and the device you are using to connect to the Internet. There are a number of ways to opt out of having your online activity and device data collected through these services, which we have summarized below:

  • Blocking cookies in your browser: Most browsers let you remove or reject cookies, including cookies used for interest-based advertising. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. For more information about cookies, including how to see what cookies have been set on your device and how to manage and delete them, visit www.allaboutcookies.org.
  • Blocking advertising ID use in your mobile settings: Your mobile device settings may provide functionality to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.
  • Using privacy plug-ins or browsers: You can block our websites from setting cookies used for interest-based ads by using a browser with privacy features, like Brave, or installing browser plugins like Privacy Badger, Ghostery or uBlock Origin, and configuring them to block third party cookies/trackers.

If you request to be added to our Opt-out lists, we will keep your Personal Information on those Opt-out lists until you request to be removed from such lists. We allow you to Opt-out of the following:

Email Records

FIOR keeps business records, including emails you send to us, for seven (7) years to meet our regulatory compliance requirements. This includes any email you send to our privacy, security or support teams.

Data Residency

Our services and data are hosted in the United States and are intended for individuals located within the United States.

US State Residents Privacy Notices

Nevada Residents

We are providing you this notice under Nevada state law. You may be placed on our internal Do Not Call List by contacting us.

Vermont Residents

Under Vermont law, we will not share any Personal Information we collect about Vermont residents with third parties, unless the law allows.

California Residents

Effective January 1, 2020, the California Consumer Privacy Act ("CCPA") provides a number of rights to California consumers. For a full description of your rights under the CCPA, please see Appendix A.

Protecting Children's Privacy Online

FIOR is not directed to individuals under the age of thirteen (13), and those children should not provide Personal Information through our websites or applications. We do not knowingly collect information from children under 13 without parental consent. For more information about the Children's Online Privacy Protection Act (COPPA), visit the Federal Trade Commission website.

Modifications to our Privacy Policy

FIOR may change this Privacy Policy from time to time. Laws, regulations, and industry standards evolve, which may make those changes necessary, or we may make changes to our Services or business.  We will post the changes to this page and encourage you to review our Privacy Policy to stay informed. If we make changes that materially alter your privacy rights, we will alert you to changes by placing a notice on the FIOR website at https://www.prosperly.app/privacy-policy, by sending you an email, and/or by some other means. Please note that if you've opted not to receive legal notice emails from us (or you haven't provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them.

If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect is subject to the Privacy Policy in effect at the time such information is collected.

Appendix A - California Consumer Privacy Act ("CCPA") Disclosures

Who does the CCPA apply to?

The CCPA provides certain rights to California residents.

What rights do I have under the CCPA?

Broadly speaking, the CCPA grants California residents the following rights:

  1. a right to request that a business disclose the personal information that the business collects, uses, discloses and sells;

  2. a right to request that a business delete the personal information that the business has collected from them;

  3. a right to opt out of having their personal information sold by a business; and

  4. a right not to receive discriminatory treatment by a business for exercising their rights under the CCPA.

What personal information does FIOR LLC collect about California consumers?

The chart below describes the categories of personal information FIOR has collected over the past 12 months, as well as the categories of sources from which the information was collected, the business purpose for which the information is collected, and the categories of third parties with whom FIOR shared personal information.

Please note that we also disclose the types of information we collect earlier in our Privacy Policy. However, the CCPA requires that we provide this information with reference to certain categories described in the CCPA and so we are restating the information here.

(Y) Most of the information personal information we have is provided by you either (a) through our website, including information you enter into our web site as well as information provided by your web browser or device, or (b) when speaking to a FIOR customer service agent. (SP) We receive information from service providers who help us provide services to you. (TP) In some instances, we purchase information from third parties. For example, we may purchase addresses for direct mail campaigns and sales leads from referral partners.

Business or Commercial Purpose for Collecting the Personal Information

  1. Auditing related to a current interaction with the consumer and concurrent transactions, including, but not limited to, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards.
  2. Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.
  3. Debugging to identify and repair errors that impair existing intended functionality.
  4. Short-term, transient use, provided that the personal information is not disclosed to another third party and is not used to build a profile about a consumer or otherwise alter an individual consumer's experience outside the current interaction, including, but not limited to, the contextual customization of ads shown as part of the same interaction.

We share the information described above with service providers to the extent necessary to provide the services you have requested and for the business purposes described above.

How Can I Exercise My Right to Opt Out of the Sale of My Personal Information?

FIOR does not sell any consumers' personal information. We have not sold consumers' information in the past 12 months.

How Can I Exercise My Rights Under the CCPA?

If you have a FIOR account:

  • Fill out an online request form

  • You will need to provide your full name, phone number, and email so that we can locate you and authenticate your identity. If you previously had a FIOR account, please provide the email and phone number you used to log into your dashboard.

  • We will authenticate your request by matching the information you provide against any information we have collected about you. In certain circumstances, if we believe it is necessary to authenticate your request and protect the security of your information, we may require additional information.

How Can I Designate an Authorized Agent to Exercise My Rights Under the CCPA?

You may use an authorized agent to submit a request on your behalf. To do so, the authorized agent must provide a copy of your written authorization to legal@prosperly.app along with a certification that such authorization or power of attorney has not been revoked and remains in effect. You will also be required to verify your identity directly with us.
